The idea of automating the different tasks within the e-discovery process is appealing.  But what is the best way to forecast the economic impact of such automation, given all the different variables involved?  Historically, many firms have focused on the “soft” benefits: reduced risk, avoidance of penalties and fines, or avoidance of settlement, all of which are difficult to quantify. But in today’s economic environment, even e-discovery initiatives must have a credible business case, with credible “hard” benefits, based on demonstrable metrics, in order to be considered by effectively funded by executive management.  Attendees can expect to learn best practices of how firms have justified their technology spend on e-discovery.

As regulation, compliance, and discovery continue to drive ECM investments, many organizations are facing a crisis: How do we make the proper investments in tools to balance the offensive (records/email management) and defensive tactics (discovery)? Mostly these investments are driven from necessity and sometimes from due diligence. Attendees can expect to walk away with approaches for delivering a top-tier compliance and litigation management infrastructure using ECM tools.

3:30 PM – CMIS: An Emerging Interoperability Standard for Content Management
David Choy, OASIS CMIS Technical Committee, EMC Content Management & Archiving CTO Office
Today's business contents are trapped in disparate content management systems, creating a major barrier for user/application to find, reuse, share, or integrate content. To mitigate this problem, a Web-based interoperability standard, called Content Management Interoperability Services (CMIS), is emerging. With a broad participation in its development, CMIS can create a new paradigm and new opportunities for content management.  In this presentation, an overview of CMIS will be given: What problems does it solve? How does it work? What capabilities does it provide? Who are behind it? And more.

A company's electronically stored information is the foundation of its success.  But when legal matters arise, that information, if not handled properly, can also be its Achilles' heel. For a company facing electronic discovery - whether through high-stakes litigation or a government investigation - two goals override all others  while fulfilling all legal obligations:

  • Ensuring ironclad security of your data and strict compliance with the law.
  • Mitigate the risk of evidentiary failure while keeping legal and operational costs to a minimum.

In this session, attendees will learn:

  • How to control discovery costs with non-linear review techniques including document clustering and statistical sampling
  • The benefits of managing multiple cases through one central and secure repository while reducing the potential for missteps when jumping from vendor to vendor
  • How to reduce the risk of eDiscovery failure with an immutable chain of custody for all your electronically stored information
  • To track and run detailed reports and metrics on all your cases to monitor outside counsel's progress
